Vehicle Rental Agreement

1. Parties and Vehicle

This Vehicle Rental Agreement ("Agreement") is between OTF Fleets LLC ("Owner," "we," "us") and the person renting the vehicle ("Renter," "you"). The specific vehicle, rental dates, pickup and return location, rate, and security deposit will be listed in your booking confirmation, which forms part of this Agreement.

2. Driver Eligibility

• You must be at least 21 years old and hold a valid, unexpired driver's license.
• You must provide a government-issued photo ID and a valid payment method in your name.
• Only you and any additional drivers we approve in writing may drive the vehicle. Each approved driver must meet these same requirements.
• We may decline any rental at our discretion, including based on the results of the checks in Section 3.

3. Consent to Background and Driving Record Check

To decide whether to rent to you, OTF Fleets LLC needs to check your background and driving history. By agreeing to this Agreement, you authorize OTF Fleets LLC and the screening companies it uses to get and review:

• your motor vehicle record (driving history), including license status, violations, accidents, and suspensions;
• identity verification and a criminal background check;
• insurance history and verification of the insurance you provide.

You agree to provide accurate information needed for these checks, such as your full legal name, date of birth, and driver's license number, when asked. This authorization covers the review for your rental request and any rental you make under this Agreement, including any extension.

If we decline your rental based in whole or in part on information in a report from a consumer reporting agency, we will tell you, give you the name and contact details of the agency, and let you know of your right to get a free copy of the report from that agency and to dispute any inaccurate information with it. Information from these checks is used only to evaluate your rental, is kept confidential, and is not sold.

You may withdraw this consent at any time before a check is run by contacting us. If you do, we may not be able to rent to you.

4. Rental Period and Late Returns

• The rental begins at the pickup time and ends when the vehicle and keys are returned to us at the agreed time and place.
• Late returns are charged at the daily rate for each day or part of a day the vehicle is late, unless we agree to an extension in writing beforehand.
• A vehicle not returned within 24 hours of the agreed time, without contact from you, may be reported to the authorities as unreturned.

5. Payments and Security Deposit

• Rental charges are due before pickup unless otherwise agreed.
• A refundable security deposit is required. It will be returned after the vehicle is checked in, minus any amounts owed under this Agreement (damage, fuel, cleaning, tolls, tickets, or late fees).
• You authorize us to charge your payment method on file for any amounts owed under this Agreement.

6. Insurance

• You must carry valid auto insurance that covers you while driving the rental vehicle, or purchase rental protection if we offer it, and show proof before pickup.
• Your insurance is the primary coverage during the rental period.
• You are responsible for any deductible, and for any loss not covered by insurance, up to the vehicle's fair market value.

7. Vehicle Condition, Damage, and Accidents

• The vehicle's condition will be documented with photos at pickup and return. Please point out any existing damage before you drive away.
• You are responsible for any damage, theft, or loss during the rental period, including loss of use while the vehicle is being repaired, towing, and administrative costs.
• If there is an accident, damage, or theft, you must call the police if anyone is hurt or a crime has occurred, notify us right away, and get the other party's name, contact, and insurance details. Do not admit fault or arrange repairs yourself.

8. Fuel, Mileage, and Cleaning

• Return the vehicle with the same fuel or charge level it had at pickup. Otherwise you will be charged for the difference plus a refueling fee.
• Any mileage limit will be listed in your booking confirmation. Extra miles are charged at the rate shown there.
• Return the vehicle reasonably clean. Excessive dirt, stains, sand, pet hair, or odors may result in a cleaning fee.

9. Prohibited Uses

The vehicle may not be used:

• by anyone under the influence of alcohol, drugs, or any substance that impairs driving;
• for rideshare, delivery, or any paid transport of people or goods, unless we approve it in writing;
• for racing, towing, off-roading, or driving instruction;
• for any illegal purpose, or outside the United States;
• by any driver not approved under Section 2.

Smoking and vaping are not allowed in the vehicle. Pets are allowed only with our prior approval.

10. Tolls, Tickets, and Fines

You are responsible for all tolls, parking tickets, traffic violations, impound fees, and fines incurred during the rental, plus a reasonable processing fee for each one we handle.

11. Breakdowns and Maintenance

If the vehicle has a mechanical problem or a warning light comes on, stop driving when it is safe and contact us. Do not have repairs done without our approval. We are not responsible for losses caused by a breakdown that was not your fault, beyond refunding the unused rental time.

12. Termination and Recovery

We may end the rental and recover the vehicle at your expense if you break this Agreement, give false information, or use the vehicle in a prohibited way.

13. Personal Property and Liability

We are not responsible for items left in the vehicle. To the extent the law allows, you agree to cover OTF Fleets LLC for any claims, losses, or costs arising from your use of the vehicle during the rental period.

14. Governing Law

This Agreement is governed by the laws of the State of Georgia. If any part of it is found unenforceable, the rest remains in effect. This Agreement, together with your booking confirmation, is the entire agreement between you and OTF Fleets LLC about the rental.
